FREQUENTLY ASKED QUESTIONS AND ANSWERS SHEET Waterside I at Bay Beach Condominium Association, Inc. as of Jan. 1st 2025 Q: What are my voting rights in the condominium association?A: There are 58 units at Waterside I at Bay Beach. Each unit owner is entitled to one indivisible vote in all matters requiring a vote of the owners. Thus, the total number of voting interests of this Condominium is 58 votes. Generally speaking, unit owners are entitled to vote for the election of Directors, the level of reserve funding, waiver of certain financial reporting requirements, and amendments to the Declaration of Condominium, Articles of Incorporation, and By-Laws of the Association. Under Florida law, votes on reserve funding, waiver of financial reporting requirements, and document amendments may be conducted at the annual meeting of the Association, or at a special meeting. Owners are entitled to vote in person or by limited proxy. The election of Directors is conducted at the annual meeting through a balloting procedure. As to the election of Directors, each unit owner is entitled to cast one vote for the number of vacant seats. Cumulative voting is prohibited. Additional voting rights and procedures are described in Section 2 of the Bylaws. Q: What restrictions exist in the condominium documents on my right to use my unit?A: Each unit is restricted to residential single-family use. No animals, wildlife, livestock, reptiles or poultry of any kind shall be raised, harbored, bred or kept on any portion of the Condominium Property. An owner may not maintain more than one (1) household pet within any Unit, limited to one (1) dog, weighing up to thirty (30) pounds, or one cat. This provision shall not prohibit the keeping of fish or a caged household type bird in a Unit, provided that the bird does not become a nuisance or annoyance to the neighbors. Any unit owner who keeps or permits a pet to be kept in his unit, is fully liable for all damage or injury to persons or property caused by the pet. The pet owner shall immediately remove any animal droppings left by the pet upon the common elements. Additionally, no signs may be displayed anywhere including, "For Sale", "For Rent", "Open House" or other similar signs. No hurricane shutters, except the models installed by the Developer or those meeting specifications adopted by the Board of Directors, shall be used. No motor vehicle shall be parked within the Condominium except on a paved surface intended for such use. Boats, trailers of any kind, campers, mobile homes, motor homes, buses, truck campers, recreational vehicles, and the like, and any vehicle without current registration or not in operable condition, may not be parked, stored or kept within the Condominium. Additional restrictions on unit use are found in Section 17 of the Declaration of Condominium and Amendments. Q: What restrictions exist in the condominium documents on the leasing of my unit?A: Written notice of at least twenty (20) days in advance to the Association of all leases is required. A copy of the proposed lease must be submitted. After the Board has received such notice and information required, the Board shall approve or disapprove the proposed lease. The minimum lease term is 30 days and no lease may be for more than one (1) year. The Board may, in its discretion, approve the same lease from year to year. No subleasing or assignment of lease rights by the lessee is allowed. No one but the lessee, his family members within the first degree of relationship by blood, adoption or marriage, and their spouse and temporary house guests may occupy the unit. The maximum number of overnight occupants of a leased unit is limited to two (2) persons per bedroom. Other leasing restrictions are found in Section 19 of the Declaration of Condominium. Q: How much are my assessments to the condominium association for my unit type and when are they due?A: Regular assessments based on the Association's annual budget are payable quarterly, in advance, due on the first day of January, April, July and October. If so, what is the name of the association and what are my voting rights in this association? Also, how much are my assessments?A: Each unit owner is required to be a member of the “Waterside Master Association, Inc. - WMA”. Your Condominium Association is a member of the “Estero Bay Improvement Association, Inc. – EBIA”; and as such you pay a share of the EBIA assessment. As an owner in Waterside you have one vote in WMA as provided in section 9.1 of the WMA Declaration of Covenants. Waterside I is one of 16 Members of EBIA; and as provided in the Articles IV of the Articles of Incorporation and Section 4 of the Declaration, casts its vote through Waterside I’s Voting Representative. The 2025 Annual assessment for each owner, as determined by WMA, will be payable in quarterly installments of $851. EBIA’s 2025 Waterside I assessment is $23,664. The EBIA assessment is funded through the Waterside I annual budget. Q: Am I required to pay rent or land use fees for recreational or other commonly used facilities? If so, how much must I pay annually?A: N/A Q: Is the condominium association or other mandatory membership association involved in any court cases in which it may face liability in excess of $100,000?
